Virginia Leave Laws
Virginia’s leave framework is currently more limited than states with broader paid leave programs, but it is evolving. Virginia has enacted a forthcoming statewide Paid Family and Medical Leave program, with benefits scheduled to begin on December 1, 2028. Until that program becomes active, Virginia’s state-specific leave obligations are concentrated around narrower protected leave categories, including organ donation leave, paid sick leave for covered home health workers, crime-victim court attendance leave, Civil Air Patrol leave, and certain military/public-sector leave rights.
The key compliance distinction for Virginia is timing. Some rights are currently operative, while the broader PFML program is a future-state requirement. Current Virginia leave workflows should separately track currently active protected leaves, currently active paid sick leave for covered home health workers, and forthcoming PFML obligations.
