Job-Protected Leave Entitlement Descriptions

These laws create a protected right to take time away from work and generally require the employer to preserve employment rights, restore the employee to the same or comparable position, or otherwise avoid interference or retaliation.

New Jersey Family Leave Act

The New Jersey Family Leave Act is the state’s core family-care and bonding leave statute. It provides eligible employees with up to 12 weeks of job-protected family leave in a 24-month period. Covered reasons include bonding with a child after birth, adoption, or foster placement; caring for a covered family member with a serious health condition; and certain family-care needs during a declared public health emergency.

NJFLA and FMLA Distinction

NJFLA is distinct from FMLA in an important way: NJFLA generally covers family care and bonding, but it does not provide leave for the employee’s own serious health condition. An employee’s own disability may instead involve federal FMLA, New Jersey Temporary Disability Insurance, employer disability benefits, or another accommodation framework.

Upcoming NJFLA Expansion

New Jersey has enacted amendments expanding NJFLA access. Official state guidance states that amendments expand access to employees of private employers with 15 or more employees, decreasing the minimum number of employees for private employers from the prior 30-employee level. For leave administration, this should be flagged as a compliance update because employers that were previously outside NJFLA coverage may become covered once the amendments take effect.

Paid Benefit / Wage Replacement Programs

Family Leave Insurance

New Jersey Family Leave Insurance provides cash benefits for bonding with a newborn, newly adopted, or newly placed foster child; caring for a seriously ill or injured loved one; or handling certain matters related to domestic or sexual violence. The Department of Labor identifies FLI as a wage replacement program and provides job protection.

Temporary Disability Insurance

New Jersey Temporary Disability Insurance provides cash benefits to workers who must stop working due to a non-work-related physical or mental health condition, including pregnancy or childbirth recovery. New Jersey states that TDI can provide benefits for up to 26 weeks. It is a wage replacement program and provides job protection.
