Rhode Island Leave Laws

Job-Protected Leave Entitlement Descriptions
These laws create a protected right to take time away from work and generally require the employer to preserve employment rights, restore the employee to the same or comparable position, or otherwise avoid interference or retaliation.
Rhode Island Parental and Family Medical Leave Act
The Rhode Island Parental and Family Medical Leave Act provides eligible employees with up to 13 consecutive weeks of unpaid, job-protected leave in any two calendar years. Eligible employees must generally be full-time employees who work an average of at least 30 hours per week and have been employed continuously for at least 12 months.
Temporary Disability Insurance
Rhode Island TDI provides wage replacement when an employee is unable to work because of a non-work-related illness or injury. It answers the pay question, not necessarily the job-protection question. Employers should evaluate TDI alongside RIPFMLA, FMLA, accommodations, sick and safe leave, or other applicable protections.
Temporary Caregiver Insurance
Rhode Island TCI provides paid leave to care for a seriously ill loved one or bond with a new child. Beginning in 2026, TCI provides up to 8 weeks of leave. Rhode Island guidance also notes that an employee must generally apply within 30 days of starting leave.
