Maryland is one more entry in a fast-growing map of programs, and HR leaders frequently read it beside Delaware Paid Leave and New York Paid Family Leave. Tracking every one of these against the master list of state leave laws is far simpler when the administration is handled as a leave administration service. The program is called Maryland Family and Medical Leave Insurance (FAMLI). It is intended to allow workers to take paid time off for certain family or medical reasons, while retaining job protection. Workers will be able to take up to 12 weeks of leave in a 12-month period under the standard benefit. In certain cases, an individual may be eligible for an additional 12 weeks (for example, if the leave is taken both for a serious health condition and for bonding with a child) — yielding up to 24 weeks in total in those scenarios. Covered Reasons for Leave Under FAMLI, leave can be taken for: A worker’s own serious health condition Caring for a family member with a serious health condition Bonding with a new child (birth, adoption, foster care) Certain family military deployment or servicemember care situations “Family members” is broadly defined to include: children, parents, spouses or domestic partners, siblings, grandparents, grandchildren, etc. Eligibility & Work Requirements To qualify, a worker must have worked at least 680 hours in Maryland over the 12 months prior (i.e., in the four calendar quarters before the leave). To be eligibility employee must have worked the hours in a position localized in Maryland. Job Protection & Return Rights Employers must maintain a worker’s position (or a substantially equivalent one) during the leave. Health insurance benefits must be preserved during leave, as if the worker had not taken leave. Funding & Contributions The program will be funded via payroll contributions from both employers and employees capped at 1.2% of wages Employers may withhold up to 50% of the required contribution from employee wages. For employers with fewer than 15 employees, counting both in-state and out-of- state may be exempt from paying the employer share (though employees still contribute). Timing / Implementation Status As of now, the program is not yet active — it’s in the planning / implementation phase. Originally, contributions were supposed to begin July 1, 2025, and benefits to start January 2026. However, the program has been delayed. A more recent law (HB 102) pushed contributions to January 1, 2027, and benefits to start between January 1, 2027 and January 3, 2028. This is a summary of Maryland’s upcoming Paid Family and Medical Leave (FAMLI) program based on the information from the Maryland Department of Labor site. https://paidleave.maryland.gov/pages/default.aspx - [Minnesota Paid Leave Law Update](https://qcera.com/blog/minnesota-paid-leave-law-update__trashed/): Additional Articles: - [Big Changes to OFLA take effect beginning July 1st, 2024](https://qcera.com/blog/big-changes-to-ofla-take-effect-beginning-july-1st-2024/): Oregon is tightening how OFLA fits with Paid Leave Oregon, and employers watching that trend often compare it with California CFRA and New York Paid Family Leave updates. Staying aligned across each program is easier when state leave laws are tracked centrally and the day-to-day work runs as a managed leave management service. This change is designed to minimize the overlap between the leave provisions of Oregon Family Leave Act (OFLA) and Paid Leave Oregon (PLO). The federal Family Medical Leave Act (FMLA) will remain unchanged. - [CT PFMLA Update](https://qcera.com/blog/ct-pfmla/): A covered employee that meets certain eligibility requirements can claim PFMLA benefits from the CT Paid Leave (CTPL) Authority. This program is funded by employee contributions of 0.5% of each paycheck withheld by the employer and paid to the CT Paid Leave Authority trust fund. - [CFRA Update](https://qcera.com/blog/cfra-update/): Did you know? Starting January 1st, 2022, the California Family Rights Act (“CRFA”) will change to allow California employees to take leave to care of “parent-in-law” as part of the list of qualifying family members. California is not the only state widening eligibility — New York Paid Family Leave and Minnesota Paid Leave have expanded coverage too. - [New York Leave Update](https://qcera.com/blog/new-york-leave-update/): Did you know? The governor of New York amended New York Paid Family leave to include sibling as an eligible relationship for benefits. New York is part of a broader trend — California's CFRA and Delaware Paid Leave have widened coverage as well. This will go into effect January 1st, 2022. - [FMLA Workweek](https://qcera.com/blog/fmla-workweek/): Employers in Connecticut should take steps to change their leave of absence policies and procedures to comply with the new law changes effective January 2022. - [Connecticut Leave Law Update](https://qcera.com/blog/connecticut-leave-law-update/): Employers in Connecticut should take steps to change their leave of absence policies and procedures to comply with the new law changes effective January 2022. - [4 Ways To Manage Your Business When You Have Absent Employees](https://qcera.com/blog/4-ways-manage-business-absent-employees/): Absence due to sickness occurs in any business, no matter the size or prestige. Most people are absent from work a couple of times a year. During that time, they can’t perform their work duties and as a result don’t meet their deadlines. The following blog lists the top four ways to effectively manage your business when your staff is missing. Let’s get to work: - [Six Strategies for Reducing Absenteeism](https://qcera.com/blog/six-strategies-reducing-absenteeism/): The Integrated Benefits Institute, which represents major U.S. employers and business coalitions, says poor health costs the U.S. economy $576 billion a year, according to new research. Of that amount, 39 percent, or $227 billion is from “lost productivity” from employee absenteeism due to illness or what researchers called “presenteeism,” when employees report to work but illness keeps them from performing at their best. Simply put, your staff are calling in sick, and it’s having a severe impact on your bottom line. If you want to mitigate the impact, it’s time to think about how you can nip the problem in the bud. - [Important Court Case Summary: Pregnancy Discrimination](https://qcera.com/blog/pregnancy-discrimination/): In fact, some groups are calling for a federal Pregnant Workers Fairness Act that would clarify and strengthen protections for pregnant employees. We break down what that meant for employers in same-sex marriage and FMLA policy, building on the earlier DOL rule expanding the FMLA spouse definition. Keeping policy consistent afterward is easier with leave management software and reliable leave management services.. This makes America the 21st and most populated country in the world to legalize it. The history behind arriving at this decision was one filled with many legal obstacles and societal pushback. - [Insights on Wrongful Termination from Gavin Kassel](https://qcera.com/blog/insights-on-wrongful-termination-from-gavin-kassel/): Can you highlight some red flags employees should watch for? Many trace back to the same pressures driving demand for FMLA and ADA labor attorneys, and our FMLA advice for employers explains how to avoid them. Clean records in leave management software and defensible leave management services are an employer's best protection against a wrongful-termination claim. that employees should be mindful of in regards to a possible wrongful termination case? How can a constructive dismissal come into play? - [Labor Attorneys In Demand for FMLA ADA and Workers Compensation](https://qcera.com/blog/labor-attorneys-in-demand-for-fmla-ada-and-workers-compensation/): A flurry of recent developments within the state of California foreshadows an increasing need for the counsel of labor attorneys. That same risk climate is what our piece on wrongful termination and FMLA and our guide to FMLA abuse address head-on. Employers who document leave in leave management software and standardize leave management solutions give attorneys far less to work with. labor attorneys. With wage increases, ADA compliance lawsuits, and changes in workers’ compensation for leaves of absence looming on the horizon, the skills of a knowledgeable labor attorney will be highly sought after. - [Increasing Trend of Paid Leave for Employees](https://qcera.com/blog/paid-leave/): Parental leave with pay is gradually on the rise. That momentum is exactly what we track in our leave management trends coverage, and it shows up in state programs like New York Paid Family Leave. Employers keeping pace tend to lean on leave management software and managed leave management services.. Recently a fast food chain in the U.S. has announced that their employees will have the benefit of 12 weeks of paid leaves under the circumstance and if the employee is eligible. The decision was based on the reason that it would cost less to give paid leaves rather than to train new employees to compensate for the absence. This is an unusually generous benefit for the employees in the U.S. Even though California has recently increased the duration of leave potentially up to 1 year combining the FMLA and the CFRA with additional company policy, they would not be paid during this time of absence. - [Everything About FMLA Abuse](https://qcera.com/blog/fmla-abuse/): Handling FMLA Abuse The Family and Medical Leave Act (FMLA) was created with the noblest of intentions – particularly the desire to allow employees the chance to balance their personal needs with their professional responsibilities. Unfortunately, many people take advantage of these intentions and abuse FMLA leave for non-medical and non-family reasons. When it comes to establishing the validity of FMLA leave, the federal law places a heavier burden on the employer than the employee, charging companies with the task of determining the presence of FMLA abuse. In fact, employees do not directly have to state that they are taking leave under the law. They merely have to provide enough information that an employer could reasonably act on. That gray area is exactly what drove cases like Moran v. Redford Union Schools and Smith v. Southern Illinois Riverboat, where documentation made the difference. Consistent tracking through FMLA leave management software and repeatable leave management solutions is what keeps suspected abuse defensible. could reasonably conclude that FMLA leave is warranted. For example, if an employee missed work after suffering a major heart attack and receiving treatment at a hospital – the employer would likely conclude that any absences due to the situation fall under the auspices of the FMLA. The specter of FMLA abuse shouldn’t hang over every request for time off. Employers need to individually assess each situation and employee. However, employers can get in trouble for not being consistent with all employees requests. an employee with a spotless attendance record should be treated the same as someone with a checkered past. Assessing a Leave Situation An employer should approach a suspicious leave situation by asking the employee to provide enough information to determine if the FMLA applies. This request can include asking for medical certification from the employee’s physician, hospital or healthcare provider. Since some employees could withhold necessary information of their personal medical situation, several factors can indicate to an employer that a leave is valid under the FMLA. First, an employee might qualify if he or she misses at least three consecutive days of work. An employee also might qualify if they have a chronic medical ailment that includes debilitating flare-ups. Qualifying situations can also include family members with a serious medical condition or if a female employee is suffering from pregnancy complications. An employer should also consider how a request for leave was made. If an employee calls in and says they are feeling sick, then standard company attendance policies should be applied. Employers should know that they are not breaking any laws by simply trying to determine why their employees cannot work. To get relevant information, employers can use a number of general questions that can be asked when employees call in to report an extended absence. HR or Leave representatives should find out the reason for the absence, when the employee first recognized a leave of absence would be necessary and if they have a chronic condition. If possible, an employer should also find out what job duties the employee can't perform and whether he or she is seeking care from a healthcare provider. The employer should also find out when the person is expecting to come back to work. After gathering all this information, the employer should then review that employee’s attendance record for a pattern of absences that a requested FMLA leave might fall into. For example, if the employee always requests for leave on every Thursday and Friday a leave request that fits this pattern should be viewed with suspicion. Investigating an Employee If an employer does suspect FMLA abuse, the company or organization is justified in conducting surveillance of the employee in question or hiring an investigator to conduct an investigation. According to Bloomberg BNA, video monitoring of the employee may be the best way to look into FMLA abuse. The video could be used to show that a person who is restricted from bending over at work has no problem doing just that while performing yard work. Of course, investigators should follow all laws, including privacy laws, while conducting surveillance. FMLA abuse expert Dana Connell told Bloomberg BNA that video evidence of an employee performing restricted activities is not a “smoking gun” and does not mean that an employer is protected from legal action should they immediately terminate their employee. In addition to surveillance and video recording, employers can also track an employee’s social media profiles for evidence they may be on vacation or unusually active for their alleged medical condition. Be Vigilant, yet Careful The FMLA does not shield employees from their work responsibilities or company policies. However, employers should refrain from trying to jump on a ‘gotcha’ moment and immediately fire someone the second a shred of evidence pops up. Employers should try to give their employees every last chance to explain themselves or rectify any issue related to an FMLA leave request. Providing an abundance of goodwill toward an employee will only strengthen the employer’s stance should the situation escalate into legal proceedings. - [FMLA Abuse Cases Summary Moran v Redford Union Schools](https://qcera.com/blog/fmla-abuse-cases-summary-moran-v-redford-union-schools/): Click Here to View or Download FMLA Abuse Case Moran v. If a worker is supplied a paid maternity leave, their company may necessitate that the time period of paid maternity leave count toward the 12 weeks allocated under the FMLA. A few companies may let workers use the full 12 weeks of FMLA along with any paid leave given. - [Department of Labor Expands Definition of Spouse to Cover Same Sex Marriage](https://qcera.com/blog/same-sex-marriage/): The time for growth, change, and advancement is here. Virginia has enacted a forthcoming statewide Paid Family and Medical Leave program, with benefits scheduled to begin on December 1, 2028. Contributions began on January 1, 2025, and Delaware Paid Leave went fully into effect on January 1, 2026, with employees able to submit claims beginning in 2026. - [Colorado Leave Laws](https://qcera.com/state-leave-laws/colorado/): Colorado's leave framework is centered around two major statewide programs: Colorado Family and Medical Leave Insurance (FAMLI) and the Healthy Families and Workplaces Act (HFWA). FAMLI provides paid family and medical leave benefits and may provide job protection once the employee meets the applicable tenure requirement. HFWA provides paid sick leave that can also cover certain safe-leave, bereavement, public health, and emergency-related reasons. - [Connecticut Leave Laws](https://qcera.com/state-leave-laws/connecticut/): Connecticut has a relatively robust leave framework built around Connecticut Family and Medical Leave Act leave, Connecticut Paid Leave, paid sick leave, and protected leave for family violence and sexual assault-related reasons. The most important compliance distinction is that CT FMLA provides job-protected leave, while CT Paid Leave provides wage replacement but does not independently provide job protection. Employers weighing their obligations across jurisdictions can browse our full library of state leave laws to see how Connecticut compares with other states. - [Washington Leave Laws](https://qcera.com/state-leave-laws/washington/): Washington's leave framework is built around several separate but overlapping programs. The most important distinction is whether a law provides job protection, paid wage replacement, or both. - [State Leave Laws](https://qcera.com/state-leave-laws/): Keeping these rules straight from one state to the next is a heavy lift for HR teams, which is why many employers turn to dedicated leave administration services to stay compliant everywhere they operate. - [California Leave Laws](https://qcera.com/state-leave-laws/california/): California has one of the more complex state leave frameworks in the United States because it separates job protection, wage replacement, and shorter protected absence rights across different laws and agencies. - [Healthcare](https://qcera.com/industries/healthcare/): Healthcare organizations face some of the most demanding leave and accommodations management challenges of any sector. The operational risk is more significant in an industry where every staffing decision affects patient care. It is one of the industries we serve most closely, because the stakes for both compliance and coverage run so high. - [Finance Insurance](https://qcera.com/industries/finance-insurance/): In finance and insurance, the pressure on leave of absence and accommodations management is rising. For HR leaders in state and local government, getting it right matters for both employees and the communities they serve. State and local government is one of the industries we serve with purpose-built leave and accommodation support. - [Education K-12 and Higher-Ed](https://qcera.com/industries/education/): For K-12 school districts and institutions of higher education, leave and job accommodations management is one of the most sensitive HR responsibilities.
